By accessing or using our website (sweetphoenix.co.za), our SaaS platforms (LogLane, Kryzzo, ComplianceGuard), or any services provided by Sweet Phoenix Creations, you agree to be bound by these Terms of Service ("Terms"). • "Services" refers to our website, SaaS platforms, mobile applications, consulting, and any software development services provided by Sweet Phoenix Creations.

4. SaaS Platform Terms

If you subscribe to or use any of our SaaS platforms (LogLane, Kryzzo, or ComplianceGuard), the following additional terms apply:

• Account Responsibility: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• Service Availability: We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.
• Data Ownership: You retain ownership of all data you input into our platforms. We do not claim ownership over your data.
• Subscription Payments: Paid features are billed through our payment processor (Paystack). Refund policies are governed by the Consumer Protection Act 68 of 2008.
• Cancellation: You may cancel your subscription at any time. Access will continue until the end of the current billing period.

5. Third-Party Services

Our Services may contain links to or integrate with third-party services, including Google Analytics, Google AdSense, Supabase, Paystack, and WhatsApp. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms and policies.

6. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be error-free, secure, or uninterrupted, or that defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by South African law, Sweet Phoenix Creations PTY Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of or inability to use our Services. Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa. Before instituting legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a minimum period of thirty (30) days.

10. Termination

We reserve the right to suspend or terminate your access to our Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
